NOTICE: New Listing Options for Sellers

This communication serves as official notice to comply with notification requirements to Participants of the Enchanted Circle Association of REALTORS Multiple Listing Service regarding changes to the ECAR MLS Rules and Regulations.

These changes will become effective on Tuesday, September 30, 2025

In alignment with the National Association of REALTORS® policy update announced on March 25, 2025, Enchanted Circle Association of REALTORS (ECAR) MLS is introducing Multiple Listing Options for Sellers. Following NAR’s decision to expand consumer choice, ECAR has updated its rules to give sellers more control over how their property is marketed while maintaining the transparency and cooperation that define the MLS system.

Brokers and Sellers can now select from three pathways: 
1. Active With Full IDX/Syndication

2. Delayed Marketing, Delayed IDX/Syndication
3. Office Exclusive

These options are designed to align with a seller’s priorities, whether that means immediate and maximum exposure, building anticipation before showings, controlling the timing of online promotion, or maintaining full privacy.

CAN-SPAM Act

CAN-SPAM Act is federal law and applies to marketing emails we send to one another. To comply, please be sure that:

  • Each email includes a clear way for recipients to opt out / unsubscribe of future emails, and those requests must be honored promptly.
  • Recipients are not grouped together in “cc” format.
  • The subject line and sender information are accurate and transparent.

Using the cc method to send group emails is not only a CAN-SPAM violation, but it also exposes everyone’s email addresses to potential spam and misuse.

Key Provisions of the CAN-SPAM Act

  • Accurate Header Information: Senders must not use deceptive or false “From,” “Reply-To,” or routing information. 
  • Clear Disclosure of Commercial Intent: The email must clearly state that it is an advertisement or promotion. 
  • Physical Postal Address: Commercial emails must include a valid physical postal address of the sender. 
  • Opt-Out Mechanism: Senders must provide a clear and easy way for recipients to opt out of future messages. 
  • Honoring Opt-Out Requests: Senders must process opt-out requests promptly, and any opt-out mechanism must remain functional for at least 30 days. 

Scope of the Act

  • All Commercial Email: The law applies to all commercial messages, not just bulk emails. Even a single message promoting a product or service must comply with the act’s standards. 
  • Text Messages: The act also regulates commercial text messages.

It’s Not Too Late! – Nominate Your Fellow REALTOR for 2025 ECAR REALTOR Of The Year!

The REALTOR® of the Year Committee invites you to submit nominations of individual REALTORS® for ECAR REALTOR® of the year.

The criteria to be used in selecting the REALTOR of the Year are as follows:

  • Must be nominated by a REALTOR member.
  • Upholds and exemplifies the REALTOR® Code of Ethics
  • Exemplifies a high level of professionalism
  • Participates in the REALTOR® Association at the local, state and/or national level
  • Serves the community, active in community and civic affairs

The REALTOR® of the Year Award is one of the highest honors given to a REALTOR® as it is true recognition by your peers. Please take the time to remember that special REALTOR® who you feel deserves this honor.

Please fill out the nomination form (SEE BELOW) as best you can. All nominations must be received by Oct. 17, 2025, Presentation of the Award will take place at the 2025 Annual Installation of Officers’ membership meeting in January.

Up Close With Board Member Annie Jo Lindsey

Hi, I’m Annie Jo Lindsey — Qualifying Broker for Lindsey Land & Home, Lindsey Vacation Rentals, and Certified Interior Decorator and owner of Lindsey Living. I grew up in Angel Fire and have always loved everything about houses — building them, selling them, decorating them and just looking at them.

My first career was as a hairstylist, and I owned and operated Studio 434 for 20 years. In 2017, my husband BJ and I started Lindsey Land & Home, and in 2023, we expanded into vacation rentals with Lindsey Vacation Rentals. Most recently, I opened Lindsey Living — a home décor, furniture, and gift store that also allows me to stage listings that need a little extra help standing out.

While I work with all kinds of real estate, my deep connection to the building world makes me a great resource for buyers trying to decide between buying or building a home. I’m passionate about what I do and feel incredibly lucky to live and work in the beautiful mountains of Angel Fire.

Home Equity Tax Takes Center Stage

As another high-profile bill, the No Tax on Home Sales Act, is introduced in Congress—joining the bipartisan More Homes on the Market Act—it’s clear that capital gains reform for home sales is surging to the forefront of the housing policy debate. The issue is even on President Trump’s radar: In a recent Oval Office exchange, the president said, “We are thinking about no tax on capital gains on houses.”  

The issue centers on the 28-year-old capital gains threshold. Current law allows individuals to exclude from their taxable income up to $250,000 in gain on the sale of their house. Married couples filing jointly get a $500,000 exclusion.  

With the increased attention to this issue, NAR has created a landing page for members and elected officials to learn more about our advocacy efforts. The landing page includes REALTOR® Magazine stories, policy briefs, and advocacy summaries on capital gains.
